Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ThunderFret — the website at thunderfret.com and its interactive practice tool (together, the “Service”). By using the Service or purchasing a plan, you agree to these Terms. If you do not agree, please do not use the Service.
1. Scope of Service & freemium model
ThunderFret is an interactive music-theory and guitar-practice platform offered on a freemium basis. Basic access, selected articles, and foundational tools are provided free of charge; a paid “Pro” upgrade unlocks additional features. The Service is provided for your personal, non-commercial practice and learning.
Free tools are provided strictly “as is” and “as available”, without any uptime, availability, or support guarantees of any kind. We reserve the right to modify, restrict, limit, or discontinue any free feature or tool, in whole or in part, at our sole discretion, at any time, without notice and without liability to you. The free version of the Service may display third-party advertising; a Pro subscription removes advertising.
2. Accounts
Some features require an account. You are responsible for keeping your login details secure and for activity that happens under your account. You must provide accurate information and be old enough to form a binding contract in your country of residence.
3. Merchant of record — Lemon Squeezy
All premium payments, billing operations, and global tax compliance are processed securely via our merchant of record, Lemon Squeezy, LLC(“Lemon Squeezy”). Legally, your purchase transaction is concluded with Lemon Squeezy, not with ThunderFret: Lemon Squeezy is the seller of record for the transaction, processes your payment, issues your invoice, and collects and remits any applicable VAT or sales tax. Accordingly, all financial disputes, chargebacks, invoicing matters, and refund requests are governed by and handled in accordance with Lemon Squeezy's terms of service and refund policy. All prices are displayed tax-inclusive: the amount shown includes any applicable VAT or sales tax, so the price you see at checkout is the total you pay. Lemon Squeezy processes card payments in USD at the mid-market exchange rate; depending on your bank's own conversion rate and fees, the amount on your card statement may differ from the displayed price by a few cents. That difference is applied by your card issuer, not by ThunderFret or Lemon Squeezy.
Subscription plans (monthly and yearly) renew automatically at the then-current price until you cancel. Cancelling is as easy as subscribing: when signed in, your profile page shows a clearly-labelled “Cancel subscription” button that cancels in two clicks — with no need to re-enter a password, call us, or navigate through menus. You can also cancel directly through Lemon Squeezy. Cancellation stops future renewals and you keep access until the end of the period you have paid for. For the initial term of your subscription, cancellation does not retroactively refund that period. We may change prices from time to time; changes do not affect the period you have already paid for.
Tacit (automatic) renewals. Where mandatory consumer law so provides — including the Dutch rules on the tacit renewal of consumer contracts — once your subscription has automatically renewed beyond its initial term, you may terminate it at any time subject to a notice period of no more than one month, and you will receive a pro-rata refund of the prepaid amount corresponding to the unused remainder of the renewed period. Such refunds are processed through Lemon Squeezy as merchant of record.
4. Order process & acceptance
Before completing a purchase you will be asked to expressly confirm — by ticking a checkbox at checkout — that you have read and accept these Terms, including the waiver of the right of withdrawal described in Section 5. A purchase cannot be completed without this confirmation, and your confirmation is recorded together with the transaction.
5. Refunds & the EU 14-day right of withdrawal — waiver
ThunderFret Pro is digital content / a digital service that is delivered immediately: your access is activated the moment your payment is confirmed.
If you are a consumer in the European Union or European Economic Area, you would ordinarily have a 14-day right of withdrawal (“cooling-off” right). However, in accordance with Article 16(m) of Directive 2011/83/EU and its national implementations (including Article 6:230p of the Dutch Civil Code), by completing your purchase you:
- expressly request and consent to the immediate performance of the contract and immediate delivery of the digital content before the end of the 14-day withdrawal period; and
- expressly acknowledge that you thereby lose your right of withdrawal once access has been activated.
This consent and acknowledgement are captured through the mandatory checkbox at checkout (Section 4). Subject to the above, and except where a refund is required by applicable mandatory law (Section 11), payments are final once the purchase is complete. Any refund request is handled by Lemon Squeezy as merchant of record, in accordance with its refund policy (Section 3).
6. Availability, changes & discontinuation
We want to keep ThunderFret running and improving, but we make no promise that the Service, or any particular feature, will always be available. To the fullest extent permitted by law, we reserve the right, at our sole discretion and at any time, to:
- modify, add, or remove features of the Service;
- suspend the Service temporarily (for maintenance, technical, legal, or other reasons);
- discontinue the Service, in whole or in part, permanently — with reasonable notice where practicable.
If we permanently discontinue the Service, access to paid features — including active subscriptions — may end. We are under no obligation to maintain the Service indefinitely. However, if we permanently discontinue the Service (or terminate your access other than for your breach of these Terms) during a period you have already paid for, you will be entitled to a pro-rata refund of the unused portion of that prepaid period, processed through Lemon Squeezy as merchant of record. Beyond that, and except as required by law, discontinuation does not in itself entitle you to any refund or compensation. Nothing in this Section limits any rights you have under mandatory consumer law (Section 11).
7. Acceptable use
The Service is licensed to you, not sold. You agree not to copy, download in bulk, scrape, redistribute, resell, sub-license, reverse-engineer, or create derivative works from any part of the Service, and not to circumvent or attempt to bypass access controls or paid-feature restrictions, without our prior written permission. You agree not to use the Service unlawfully or in a way that harms the Service or other users.
8. Intellectual property
ThunderFret, the interactive tool, and all of its content, design, and underlying code are owned by us and protected by copyright and other laws. These Terms grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for your own practice.
Your own work stays yours. The riffs, tabs, exercises and other material you create in the tool belong to you. If you are signed in, we keep a copy so that your work survives a lost or cleared device and is available on your other devices. You grant us — and the hosting providers listed in our Privacy Policy that store it on our behalf — only the narrow, non-exclusive, royalty-free permission needed to do that: to store it, back it up, and show it back to you. We do not publish it, we do not use it for any other purpose, and it is deleted when you delete your account.
The backup is a convenience, not a guarantee — please keep your own copies of anything you cannot afford to lose. This does not limit our liability where mandatory consumer law says it cannot be limited.
9. Cookies & similar technologies
We may use cookies, local storage, and similar technologies to operate the Service — for example to keep you signed in, to remember your settings and practice progress on your device, and to understand how the Service is used. If you are signed in, your practice progress is also backed up to your account rather than kept only on that device. Some of these are strictly necessary for the Service to function; others may be introduced over time for functionality or analytics, in which case any consent required by applicable law will be requested. 10. Disclaimer & limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service or these Terms is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential losses. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Your statutory consumer rights
If you use the Service as a consumer, you have rights under mandatory consumer-protection law that these Terms do not affect. Where anything in these Terms conflicts with those mandatory rights, your statutory rights prevail.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where the changes are material, take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Netherlands, and any disputes are subject to the courts of the Netherlands, without affecting any mandatory consumer rights you may have in your country of residence.
